State Office of Public Defenders has absolutely no accountablility. A regional director can threaten a client in writing...and nothing is done. The chief Public Defender Randi Hood (rhood@mt.gov) does not return calls, does not answer formal, written complaints, and never is available.
Sources tell us Ms. Hood is married to a recently retired Assistant Attorney General. Talk about inside deals, and conflicts of interest....

A 2009 audit of the (Montana Office of Public Defender) by consultants with American University in Washington, D.C., faulted the agency for failing to address such conflicts of interest. The consultants wrote that lawyers should not represent clients if they have a conflict of interest in the case. Such conflicts are not resolved by transferring the case to another lawyer in the same firm.
The DC group, nor "newspaper" mentioned Hood's personal conflict....

The Hamilton office of the OPD is having difficulty dismissing something that is not a crime, why? the prosecutors, law enforcement's necks are exposed, and they wanted maximum impact on their improper seizure, found in 4th amendment in the United States Constitution. Is Montanistanin the United States? Part of their name is DEFENSE, where is the sense?:

Montana is ranked 48th in the Nation for Justice. The American Civil Liberties Union (ACLU) sued the state of Montana due to inmates having no rights, waiting more than they should for trial, and a backlog of defendants that were not being represented. This case was taken in approximately 2006.
(This is not an advocacy for the ACLU, it is just the recent Judicial History in Montana).
It took only a couple of years for the system to be corrupted. Lawyers who could not make it on their own, are now part of the Montana Public Defenders.

Please do come in, enjoy the harassment. No matter if you pay an attonrney thousands of dollars, or actually qualify for this dasterly "service" your behind belongs to Montana, and its corrupt judicial system. We describe it as allowing "Pigs to Fly" (anything goes).
- Predetermination of non-eligibility (although documents such as 1040, state certification of income are presented).
- threatening letters on letterhead from lead attorneys from the Montana Public Defenders office.
- Being treated differently (this is called discrinination) in eligibility issues.
- No social workers are employed by the Montana Public Defenders. (this has been corrected--the Missoula office hired a social worker).
We will therefore hereafter call them: THE MONTANA PUBLIC PRETENDERS

Dear Ms. Hood,
Recently I was in oral argument against an Attorney General in the 21st District. Before the proceeding I presented a conflict of interest to the court, and opposing counsel. It was ignored. (Randi Hood ignored a conflict of interest in her own household which compromised justice.)
The AG gets what they want, including an in with the MT OPD. Enter Ms. Randi Hood, Chief Public Defender, State of Montana. A written complaint, involving written threat as to "services" of MT OPD went silent, no response, nothing. It brought in a new receptionist--the last one was walking evil. The "services" I've enjoyed:
1) Inablility to dismiss case that did not involve a crime (peaceful assembly on Public property as trespassing).
2) A case ongoing 10 months (on Sept. 10) filed without probable cause (again, no crime) and no dismissal accomplished by the MT OPD. The Washington DC group indicated conflict of interest was a problem in OPD; I am aware of your status with a retiree of the AG office, who had been working as you were chief defender. I'm sure he currently has no contact whatsoever to the office today via cardgames, golf, or vacations. (Perhaps Ms. Hood does not have a telephone, or email capability so "favors" from the Montana AG office cannot arrive at home.)
I came across a "student Prosecutor" who now works for you in Billings. Didn't I read in Montana Code that Prosecutors could not be Defenders? What about the "students run wild" in the 48th ranked State for Justice. You might as well hire 2nd year students--they are fully protected lawyers. (Ask your husband).
I am not impressed with your contingent of lawyers, or service. It is appalling, your interaction and connection with the AG office, a group of people who threatened my career (gone) and my house (remains) in 2007. I have yet to commit a crime in Montana.
I dont think you should stay on, due to not returning calls, or a written complaint, and never available. This note would have been sent to the Montana Standard (in Butte, MT), but I will give you some courtesy that I am not sure you deserve. Here's my second complaint in writing.
Make no mistake, I feel resignation is proper here.

A written, formal complaint was filed with the State Public Defender, Ms. Randi Hood in September 2009. No written response, verrification of complaint, or other notification was made. Could this be negligence? Ms. Hood was in court, and could not respond to complaints as per the person responsible to answer the telephone. Butte, Montana is the mining city, lets hope the Montana Public Defenders mines up a response. Lets hope that it is not ok to threaten a defendant with thier "services". [Feb 2010]

Telephone calls are not returned for at times more than 48 hours. A call was made prior to trial, at 17:10 hours, the continuance was granted 5 days prior. It has been related that Montana citizens have gove into crisis (like tried to kill themselves) when Montana Public Defenders do not contact them abouut their cases. If we rank 48th in the US, it is not good. Montanistan has one of the highest suicide rates too.
The New York Times reported in 2005 that Ravalli County has twice national suicide rate.

Lets give these guys the perspective they deserve. What would you do if judges, prosecutors, and law enforcement are all working on one side? This is what the US DOJ is charging BP Oil with: a RICO violation: (once used against the MOB), just like we identified in Beneath the Beauty for George Corn.These defenders cut whatever deal they can to lighten their overworked load. Frustration on the part of the clients are understood, and lots of WTF's for those who actually know that they are getting the shaft.
It is not right to blame the Montana Public Defender system, it is the Montana Justice System that makes the defender system not work so well. That is the message the websites, DVD, and our press releases have made since 2007. No need to pound an entity that is already getting a pummeling from the State of Montana justice system in Montanaistan.
