Hamilton Police cover up Felony Hit & Run of City Councilman
Police Chief, Officer involved


Hamilton, Montana- A hit and run accident took place at the intersection of Foxfield St and US 93 at 2 pm. September 14, 2007. A 2001 Ford pickup headed westbound on Foxfield St. broadsided a 2006 Dodge pickup heading northbound on 1st St. or Highway 93 within the City Limits of Hamilton. City councilman Mike Lasalle was driving the 2001 Ford pickup which was cited by HPD for failing to yield at the stop sign at Foxfield St. and US 93. Lasalle left the scene of the accident.

Hamilton Police Chief Ryan Oster was observed to be at the scene, accompanied by Officer Nic Painter, who wrote the police report of the incident. In the report, Painter only offers that the vehicles were separated, and not that Councilman Mike Lasalle fled the scene of an accident. Oster allegedly told Councilman Bob Scott that the HPD allowed Lasalle to flee the scene in a telephone conversation. An elderly man was hospitalized due to the accident who was riding in the passenger seat of the northbound pickup; HPD officers only offered that the name of the driver would be released in the police report, not at the scene.

Witnesses to the accident took pictures of the incident, which only included one disabled vehicle, the 2006 Dodge pickup which was northbound at the time of the incident. An accident report was called into the Montana Highway Patrol using the 800 number provided in the phonebook. Further, a call was placed into the commander of the State Patrol to inform them of this cover-up. Even though the state has jurisdiction on any roadway in the state, the state patrol indicated that they would not investigate.

ntion of the media, as this is the second felony cover-up since the summer. In early June, 2007 a spouse of County Commissioner Carlotta Grandstaff received 57 stitches in his head from injuries received on the property of the Corner Sports Bar 1St Street (Hwy 93) Hamilton. No one was charged in this incident. Officer Nic Painter was also assigned to investigate this incident.

A regular city council meeting is scheduled for Tuesday October 1, 2007 at 7pm located at Hamilton City Hall NW corner of Bedford St. and 2nd Street on the2nd floor. Representatives of We The People Ravalli County will be in attendance.

Ravalli County Attorneys help themselves to Prosecutor award.
Nominate themselves, despite constitutional violations

Hamilton, Montana- Ravalli County Attorney George H. Corn, nominated Bill Fulbright, a prosecutor from Hamilton as the Montana Coalition Against Domestic & Sexual Violence (MCADSV) “Prosecutor of the Year”. Fulbright has been a prosecutor in Hamilton for the past 5 years, according to Joel Gallob, reporter for the Ravalli Republic. Gallob does not site any other references besides prosecutors from the Ravalli County Attorney office in his story from October 8, 2007 published in the Republic.

Comment was not available from Kelsen Young, Executive Director of MCADSV from Helena, who gave the award Friday in Hamilton.

Fulbright violated the basic rights of a defendant in a case where prima facie evidence, that is, evidence to proceed with trial was lacking. In a statement made to defense council Sasha Brownlee prior to trial, Fullbright exclaimed that “… if this had been anyone but (the defendant) the case would be dismissed.” This statement is evidence that Fulbright does not respect the rule of law, and prosecutes with malice. Further this statement violates the Montana Constitution Article II section 4 with respect to equal protection under the law. The same legal provision of equal protection is found in the 14th Amendment of the US Constitution.

Fulbright demonstrated further evidence of malicious prosecution when he asked a county judge, JP Jim Bailey to violate rules of the court as they pertain to evidence. In a motion dated July 30, 2007 in State of Montana v. Mike Spreadbury case #TK 2006-3068. Bill Fulbright asked a judge to break the rules of the court for evidence when he failed to submit discovery, a responsibility of the prosecutor on any case. When discovery is not submitted, that is immediate grounds for dismissal. When Ravalli County is involved however, anything apparently goes.

Dean Eck of the University of Montana-Missoula School of Law states that when a lawyer initially makes false statements to judicial officers, then they are liable for ethical breech of the Montana Bar Association. Shawna Ryan, administrator for the Montana Bar in Helena, MT could not be reached for comment.

George H. Corn, the nominator for the award, asked the judge for the same evidence request (on the same day) when Fullbright was denied on July 30. Corn’s version of the motion was accepted, due to making false statement of “severe injury” to the witness when in fact no medical attention was necessary as the witness inflicted damage to themselves.

As with his nomination for the prosecutor award, George H. Corn gets what he wants whenever he asks. Kathy Seeley, Assistant Attorney General for the State of Montana, and Josh Van De Wettering US Attorney in the Missoula office, in letters dated in April and September respectively state that George Corn has “wide latitude” in performing duties as County Attorney for Ravalli County, which seems to mean that he is above the Montana and US Constitutions. With the State of Montana and the US Justice Dept. protecting them, an award is small work for George H. Corn.

A defendant’s 6th Amendment right to speedy trial was intentionally violated in the above mentioned case by the Prosecutor of the year, Bill Fulbright. Initial appearance was on January 5, 2007 and Justice Court “trial” was on August 8, 2007. Seven months is far greater than the 2 to 4 months required by speedy trial provisions. This amendment was written by the founding fathers to protect against false charges, and their associated damages to the citizen.

Article II Section III of the Montana Constitution gives inalienable rights to Montana citizens. The provisions are for a healthy environment, and to appropriately defend property. Bill Fulbright, and George H. Corn were petitioned by 10 Ravalli County residents in July 2006 in a community nuisance petition to uphold these citizens right to a healthy and safe environment. The RCAO ignored the petition, and decided to prosecute without evidence, which violates rule 3.8 of the Montana Bar Association for prosecution without probable cause. Preamble to the Montana Bar code of ethics is subsection (6) which states that the law should not be used to intimidate or harass individuals. Obviously the Montana Bar association rules, the Montana Constitution, nor the US Constitution applies to the prosecutors in Ravalli County.

Can a lawyer who wins a prosecutor of the year award violate the basic protections available to Montana residents, and American citizens? When RCAO help themselves to a prosecutor award it is mere peanuts in comparison to helping themselves to people’s rights.

No Help from Governor, Congressmen in Montana on criminal Civil Rights transgressions; Attorney General, others assisting perpetrators and co-conspirators, not constituents.

Hamilton, Montana- In a state of less than 1 million residents, Montana has been ranked 48th in the nation for Justice , beating out Jena, Louisiana for the top spot. One would think that political leaders would take strides on their own to fix the problem: even with our groups pleading, no help has been offered by our elected officials in Montana. US Senator Jon Tester (D-Mont) referred “We the People” back to the corrupt system in a letter dated September 12, 2007. In that letter, Tester claims: “…the system is designed to solve these problems.” In referring us to the Montana Bar Association, it put us in contact with Shaun Thompson, disciplinary counsel for the Bar. Mr. Thompson looks the other way when multiple bar code ethical violations are transgressed, saying that “wide latitude” is given to these prosecutors; our question is who upholds the State and Federal Constitution to the violators?

The Assistant US Attorney brushes off embezzlement by law enforcement, and civil rights crimes as “trivial” and also laments how officials in Montana have “wide latitude” in their scope of duties in his September 24th 2007 letter. This federal official has made a sworn oath to protect the US Constitution. Without the help of John Mercer, #3 in the US Justice Department before Gonzales left the helm, the State of Montana is left without a US Attorney to call it’s own. Perhaps if we had one, we would not have to take our case directly to Washington, DC.

Assistant Attorney General Kathy Seeley joins the group protecting criminals. In her April letter to our group, she claims that George H. Corn, Ravalli County Attorney has “considerable latitude” in exercising his duties, and can be stopped only by a vote of the electors of the county. Sources to our group indicate that Corn is being groomed for the Montana Attorney General. If he is allowed to violate state and federal rights, can Montanans imagine what latitude he will have as the chief law enforcer and state attorney?

We the People of Montana would like an explanation by local, state, and federal officials as to why our rights as protected in aforementioned constitutional documents are being breeched? Perhaps they could describe these actions and inactions to George, a member of our group. His doors were kicked in by Hamilton Police, his house searched, and property seized. George does not live within the city limits of Hamilton, and these officers were acting outside of their jurisdictional limits. Now that’s wide latitude.

Wide latitude comes in the form of jail time, threats of losing her kids, and expensive attorney fees, and court appearances. This person from our group had a bumper bump in a drive through, checked with the other driver and agreed there was not enough damage to claim, nor alert the authorities. This woman had hit and run arrest, and other abusive damages, such as excessive intervention with a concurrent divorce proceeding. Mike, one of our city councilman put someone in the hospital on felony hit and run, and was allowed to leave the scene of the accident by Hamilton Police officer Nic Painter and Chief Ryan Oster at the scene. This proves what US Attorney, Assistant Attorney General, and Disciplinary Counsel Shaun Thompson told us all along: these officials can do what they please.

Nic Painter, the aforementioned HPD officer has really taken advantage of his latitude. He has covered up two felonies since the summer, and holds the “record” for DUI arrests (over 100) before he was sworn as a full police officer. Noteworthy is that the city of Hamilton has never incorporated, making the very existence of city personnel, including police officers suspect.

Ken Bell, Hamilton City Attorney has prosecuted hundreds of cases without swearing in as city attorney. While prosecuting these cases, he accessed a federal crime database multiple times, when each would be considered a felony to do so without proper access. Helping himself to innocent citizens would rank pretty high as to taking latitude in his position. These examples are the mere beginning of a deep, and engrained corruption within our county and state. It is no wonder that no congressman, or elected state official would look into these civil rights crimes on our behalf.

The problem continues through the State Director and Counsel for Max Baucus in Billings, Montana. Melanie Hanes was a former prosecutor for 20 years in Montana. No doubt is protecting the future Attorney General, George Corn from Ravalli County. Without seeing our 120 pages of documentation of civil rights crimes, Ms. Hanes gave unsolicited legal advice, and forcefully rejected our request for a congressional inquiry. Congressional aides don’t usually overpower their constituents, and not allow them to get access to their representative. Not only did she do that, but acted inappropriately on the phone. Senator Baucus obviously made a misjudgment on her hire. When a senator or representative has no concern for the civil rights of their constituents, why then should Max, Jon, or Denny represent Montana?

In all, three representatives refused to help us with Civil Rights issues. The representatives from We the People feel there is much more to the story than we have witnessed through Ravalli County, into the State of Montana, and into federal levels. We have indicated to the FBI regional office an agent who threatened one of our members on the phone, and defended law enforcement as “the best he has worked with”. The original call was not directed to law enforcement, but rather to safety at the Rocky Mountain Lab in Hamilton. With a sworn affidavit sent to the regional office, we hear through secondary sources that the situation has been corrected. It is obvious to us that there is more to this picture if a FBI agent, US Attorney, and officials of the Attorney General office wish to protect it. Governor Schweitzer refused to meet with us, asking us to turn in paperwork. Seeing how we recommended a State Police six or more weeks ago without response from him, we feel Governor Schweitzer was not left out of the loop. Assimilation of personnel has been seen from corrupt local police to the NIH Level IV Lab in Hamilton. We have made NIH headquarters aware in Bethesda, MD and feel that with their site visit and testing they are on top of protecting their lab and the public.

When state inalienable rights, and US constitutional rights are allowed to be compromised by local, state, and federal officials, we organized to take action to protect our community. To date, we have observed and documented violations of 1st, 4th, 6th, and 14th amendment rights in Ravalli County, Montana. Within the state constitution, article II section III and IV have easily been breeched.

It is incomprehensible that US senators Baucus, Tester, and Representative Rehberg refused to help with respect to civil rights crimes. It is time for them to be recalled in the next possible election, if not sooner. We seek prosecution under 18 US code section 241, 242 for the criminal actions, and 42 US Code section 1983 for civil conspiracy to deprive civil rights. At present, we are in contact with the assistant director of the FBI in Washington, DC and are also in contact with the criminal and civil sections of the US Dept. of Justice in Washington, DC. Our group has a list of “persons of interest” who acted under color of law, and helped with this conspiracy to take away rights in Ravalli County. It includes, judges, attorneys, prosecutors, law enforcement, and government officials from Montana, and federal employees who have covered this up.

Please see the attached documents which include a former press release, and a letter to the editor of the Ravalli Republic, the voice of corruption in Ravalli County. Our group has made several requests to Lee Enterprises of Davenport IA, including Mary Jundt CEO. She referred us to their corporate attorney for cover up. We seek the removal of Sharron Schroeder as publisher due to printing false arrests, printing cover stories to not allow the truth with public officials, and not allowing publication of ads. This is an infringement of our first amendment rights, as is a breech of freedom of press. We wish to have a free press in Ravalli County, to stop this criminal activity from continuing.

Who Will “Bail-Out” Justice?

Hamilton, Montana- As Editors of mainstream newspapers, will you speak for the American Public with respect to Justice? Since September 11, 2001 our first responders and general public have not seen the collaring for those responsible such as Osama Bin Laden, the head of the terrorist network responsible for the destruction of the Word Trade Center Towers in New York City.

In today’s America, a minority of police officers are not trained, and when these officers are on the streets, Americans see no justice. It does not matter if you are in the Big Apple, or in the Bitterroot Valley of Montana, justice is compromised when justice is not served. The American people suffer when justice is lacking. Abuse of justice means our Constitution is at risk. Naming a different time when our constitution was at risk was prior to and during the Civil War.

Our Attorney General and President are Black. What is stopping them from making up for lost time for civil rights and enjoining justice? A purposeful financial crisis set up by the outgoing president, who is evading prosecution for murder, and wagging the dog. This release is to remind 44 that he should not forget his roots; there are Americans suffering on par with the Abu Ghraib and Gitmo situations: our torture is psychological instead of physical and psychological combined. These guards, and MP’s in those prisons have kin running the streets of America.

Holder, our United States Attorney General has made talk about race relations, and upholding civil rights. Does his department not understand that this can happen White on White, Black on Black, and not merely a mixed color race situation? We need stringent upholding of equal protection, and following the rules of the courts. Our law enforcement has to be 100% public servants, as most are. The training and continuing education of these officers needs to be stringent; they have the power to take lives, and ruin lives at their choosing.

Do we want to live in a saved economy with no justice? It is time our papers speak the truth about George W. Bush, his failed policies, and how his Administration allowed the injustices to spill into our states and towns of America. The Newspapers need to speak for America: we want international and domestic justice, or we don’t have a United States with values and a constitution to go home to at night.

We Welcome GITMO in Montana

Hamilton, Montana- For a group who have pressed justice to the last two administrations, with success, we ask that the US Justice Department, and President Obama seek out The Two Rivers Detention Center in Hardin, Montana as the new home, and sanctuary of Justice for the detainees of Guantanamo Bay, Cuba.

We believe in a “trickle down” Justice, and if the world’s attention is focused on Montana, we believe the justice abuses that have been documented in our state will only improve with the backing of the US Justice Department, world viewers, and the US Court System of Justice.

Hardin, in Bighorn County Montana is a mere 46 miles to the nearest US Court in Billings, MT. We applaud the Obama Administration for bringing justice to the GITMO detainees in Montana; it is the safest location for both US residents, and detainees.

US Senator Max Baucus does not wholeheartedly speak for the constituents of this state, he is a national senator similar to John McCain of Arizona. We need industry, we need justice. Bring the prisoners to Hardin, MT. These prisoners are political, not dangerous.

In the words of Greg Smith, Two Rivers Authority, “it is our patriotic duty to house these detainees…” and to bring them true justice. We agree.

Some very suspicious events transpired regarding this event, and the world media may not have “connected the dots”, a problem our government had prior to September, 11, 2001. The Chief Justice of the US Supreme Court spoke on September 13, 2007 at the University of Montana Law School. Two days later, the Montana Bar Association, (clearly not interested in justice in Montana) issued a release two days later urging President Bush to release the GITMO detainees. President Obama consulted with the then Crow Agency Head during his campaign, and at the time of his death some months ago, the entire Montana Congressional Delegation from Washington, DC attended his funeral. This arrangement in Hardin was likely set up nearly two years ago.

For a state that was ranked 48th in the nation for Justice in September 2007 as reported by National Public Radio, we seek the detainees to shed justice on sovereign US soil known as Montana. Bringing the GITMO detainees to our state will bring a world audience, and world class justice, something these detainees, and Montana residents deserve.

These detainees are not the kind that would require the maximum security. From the publication My Guantanamo Diary it indicates that most of these detainees were merely seeking business in Pakistan to be picked up by the Pakistani Army, only to be sold to the US Military as “suspects”. We reject the idea that the Billings Courthouse would have to be reconstructed, nor the jail inappropriate for housing these “suspects”. Billings, MT is a short flight from Denver, Colorado and would be central to the lawyers who may defend these suspects. Easy access for the defense will facilitate justice.

Since the trickle-down stimulus does not seem to be working in the nation, it is time to try direct investment, and direct due process in Montana. Our web -sites as listed as the informational section of this press release have caused more than 30,000 Americans to reject Montana as a tourism or investment due to its justice issue. Our intention was to create justice in Montana, not hinder commerce. A way for the Obama Administration to directly inject a stimulus into our economy is to provide jobs in Hardin, and indirectly provide justice with the attention the court proceedings would bring.

Members of our group have also been picked up on false warrants, had property seized without warrant, and been the victim of prosecutorial and equal protection violations. Our Highway Patrol does not issue test scores for recruits, and engaged in a criminal scheme with our county attorney, a local paper (whose parent company also owns the Billings Gazette) to prosecute victims of crime. Talking points do not cure injustice; indictments do.

We hope to learn from the detainees, and honor their courage. We want justice to be served for them, and us; two groups who have been served injustice. We read in My Guantanamo Diary how there is no justice, there are no rights, and there is no way to change the situation. We have been dealt the same, without the physical torture; however psychological torture, coupled with law enforcement abuses can break any person.

Secretary of the Interior Salazar made a speech in Helena, MT yesterday about the $3M injection into our park system, and mentioning how tourism is a major source of funds for Montana. If a river of injustice flows through it, nobody will come, Mr. Salazar. We have been a voice in the wilderness, one which have brought top Justice officials from the US and Canada. If US Senator Max Baucus (D-MT) is shielding constitutional criminals in Montana, no number of speeches will change due process issues. This is not about professional adjustment; this is about crimes against the US constitution where the perpetrators need to be incarcerated, and those detainees and US citizens who reside in Montana given injustice a breath of fresh air. Let the Hardin prison set us free.

It all begins when the World tunes into Montana, where justice will redirect us from the forays our Nation thought was the best course. President Obama describes this time as when we “…lost our moral compass.” A similar time was the Battle of Little Big Horn near Hardin. Let’s correct those problems and raise America up for the world to see our shining light. It all starts in Hardin, Montana. Let’s bring a new justice there: fixing the problems of Guantanamo Bay Cuba for the world to see our courage and integrity.

We Know Who Jim Messina Is; Do You?

Hamilton, Montana- Our group has seen the fixing ability of Jim Messina, Deputy Chief of Staff of the White House. We have requested assistance in several areas from his former boss, US Senator Max Baucus (D-MT). Senator Baucus has a mail theft report from the US Postal Inspection Service, letters and documentation that were brought to the attention of the former Deputy Director of the Federal Bureau of Investigation (FBI) concerning our civil rights. We witnessed Jim not having any control over his staff, like Melodee Haines Baucus’ State Director Billings, Montana office. Messina is the epitome of the permanent campaign, translating from Karl Rove in the previous administration to Obama’s political “go-to man”, taking up office space in the West Wing.

The common denominator is Jims nickname“The Fixer” (Time magazine Feb. 21, 2009). He certainly has a few things under the rug at the moment, including the entire justice system of The State of Montana. With newly elected state Democrats: AG Steve Bullock, Governor Schweitzer, veteran County Attorney George H. Corn, and two US Senators who wear the donkey. The web site www.MTjustice.info will attest to the dire state of affairs in Montana (ranked 48th for Justice in September 2007 by NPR). This is no place to be truly proud of, as the native of Boise Idaho likes to claim. In fact, it “…teared him up” to hear his name as “Jim Messina of Montana” upon appointment (to The White House).

Of the staff at 1600 Pennsylvania Avenue, Mr. Messina is by far the weakest link, the biggest loser, and the least fit to survive in that environment. We have reviewed the staff, and can say with certainty that Messina is a political appointment, that adds little value to governing the nation. In fact, we are certain that Jim Messina is responsible for the stupidity, and disrespect it took to fly an executive airplane of the United States, escorted by a military fighter jet over New York City last month.

For Mr. Messina to call a national war hero, prisoner of war (POW) and a presidential candidate a “Schmuck (Time August 27, 2008)” shows Mr. Messina’s true character. Montana has more veterans per capita than most US states; this demonstrates Mr. Messina’s operation, respect for the United States, its military, and Montana.

Please send Jim Messina back to Montana, allow him to have a photo op of the snow capped Bitterroot Mountains as he lands in his “hometown” of Missoula, Montana. We think he should get a taste for having no justice, no rights, and no way of doing anything about it. Funny, these words were also the last from a GITMO detainee to his parents before the frozen “cleaned” body arrived. Welcome home Jim.

Montana Attorney General Hangs Up on Justice

Hamilton, Montana- When making a call to give information about suspected law enforcement rape, one would expect that there would be a person ready to take down information, and follow up. The Montana Attorney General office is quite different; they hang up the phone: repeatedly. Such is what happened today at 10:30am when information was attempted about suspected rapes in Lincoln County. The number is published in the telephone book as the public’s way to communicate with the chief law enforcement officer for the State of Montana. Maybe they are not sure who they work for. How will US Citizens who live in Montana get justice when this happens?

At an informal meeting with The Lincoln County Watch on May 16, 2009, “We the People” of Montana obtained credible information that 11 suspected rapes have occurred in Lincoln County, and none of them have been solved. Apparently, a drug is used that dissolves and is difficult to trace, and may be used in the veterinary industry. The Lincoln County Watch has gained support with county veterinarians, and citizens alike. The group has collected testimony, gathered evidence, and has requested information from local officials, but has not been able to meet with Lincoln County Sheriff Daryl Anderson to date. Among the suspects are the Law Enforcement themselves, possibly the reason that Anderson refuses to meet with the Lincoln County Watch. When Law Enforcement are suspected in crime, as has been documented by “We the People” in local, county, state, and federal levels, a jurisdictional change needs to happen. By calling the Montana Attorney General office, it would bring the jurisdiction to the proper level. By having the receptionist tell a caller that they should contact their county attorney, it is being ignorant to the situation, and “…hanging up on justice.”

This situation with the Montana Attorney General’s office is indicative of the 48th national ranking that the State of Montana has. This action can be traced to the Attorney General himself, or his Division of Criminal Investigation (DCI) director who refused to investigate a felony hit and run accident on September 14, 2007 where a city police chief covered up an accident caused by a Hamilton City Councilman (see Law Enforcement Watch at www.Bitterroot-rising.org  for details). This matter has been given to Governor Schweitzer’s office, and the FBI, who has jurisdiction over the State Attorney General to ensure justice is served in every county in Montana, every day of the year.

Spreadbury to run for Hamilton, MT Mayor

Hamilton, Montana- The race for Mayor of Hamilton, Montana is presently between an non-elected incumbent and a challenger. The challenger is Michael Spreadbury, an advocate for equal protection under the law, and local watchdog for the people.

Spreadbury is a strong advocate of justice; when a felony crime was committed in the City of Hamilton and covered up by law enforcement, and the current council, he voiced his concern. The Federal Bureau of Investigation is retraining the Hamilton Police Chief for this act in 2007. In the Montana Code, it states powers of the Mayor (MCA 7-32-4103) which is supervision of the police department. Hamilton police officers have been acting outside the jurisdiction of the City of Hamilton; this can be attributed to a deficiency in the acting Mayor, Jerry E. Steele. Candidate Michael Spreadbury has experience as a federal officer working with law enforcement, and fire personnel from around the United States. As Mayor, the duties of coordination and supervision of the police department will come as second nature.

The voters of the city of Hamilton asked the council and mayor to have an election for a city treasurer. This was not accomplished. To deny the will of the voter goes against Article II section I of the Montana Constitution: popular sovereignty (all power to the voters). It also violates free speech, or 1st amendment protections. Michael Spreadbury has entered this race to attempt equal justice under the law, and to return the city government of Hamilton back to the people, where it belongs.

The City of Hamilton has seen great annexations of land which has lost sight of its city boundaries, and responsibilities. It is time for a true public servant to enter as Mayor of Hamilton, one with trusted public service and dedication of service. Our last mayor resigned due to non-cooperation with the council, and also non-supervision of the local law enforcement. The voters of the City of Hamilton, Montana deserve a choice that is fundamentally different than the status quo. The incumbent Jerry E. Steele has served as city councilor and acting Mayor. He has shown his capabilities and fell short. Candidate for Mayor Michael Spreadbury is ready to put his best foot forward for the city of Hamilton. “Beneath the Beauty”, a documentary film on local and national Justice issues to have debut in Hamilton, Montana.


Hamilton, Montana- A professionally produced, and edited documentary commissioned by We the People of Montana will debut at the Eagles Lodge in Hamilton, MT on Saturday February 6, 2010 at 5:30pm. Admission is $5 at the premiere. Look for other public showings in Stevensville in the weeks following.

A wide range of interviews were sought as information for the documentary, from the local area. The film will examine the health care issue, due to Sen.Max Baucus (D-MT) hailing from the state of Montana. Staff from senator’s Washington DC office held a public meeting regarding healthcare at a hospital in Hamilton in the summer of 2009. Although no improper conduct occurred, comments within the meeting were indicative of the injustice the citizens of the United States feel about healthcare.

The film also covers the explosive local issue of planning and land use, which got so contested, that the Montana commissioner of political practices thought there was “something in the water” to cause such a disruption. Hear from state politicians, local professionals, social activists, and others.

Hamilton Police Officer Fired.

Officer Nic Painter of the Hamilton Police Department was let go despite hundreds of arrests for DUI without being sworn in as an officer.  He was affectionately known as SUPERCOP to those who knew him well.

Apparently, even the President of the United States could not stop this man.

His favorite tactic was to never have probable cause for any of this incidents with the public; this proved to be his way of being promoted to Detective.  Even though we were all blinded by his shaved head, we are all relieved that SUPERCOP is now no longer a law enforcement officer in Hamilton, Montana.  He can be seen with two other officers checking a driver for DUI who had not been drinking on our feature documentary, Beneath the Beauty (available: www.beneaththebeauty.com) .

Word on the street is that he enjoyed taking underaged girls into bars, and after supervising them for a short while, it is undisclosed what he later did with these women.  We later found out that he married one of these young women.

We wish Nic Painter Luck in his future, knowing that he has six (6) bumperstickers which read: BAN SUPERCOP.

Civil Damages Sought in Montana District Courts.


Hamilton, Montana- In three (3) separate civil cases, $1.2M is sought against Defendants Nansu Roddy, a Hamilton Librarian; Kenneth S. Bell, Hamilton City Attorney; Angela Wetzsteon, a law student in 2007 and George H. Corn, Ravalli County Attorney and supervisor for Ms. Wetzsteon.

In Spreadbury v. Roddy, it is alleged that Ms. Roddy intentionally gave false information about a conversation outside the Bitterroot Public Library on November 4, 2009 which incarcerated unsuccessful Mayoral Candidate Michael Spreadbury.

In Spreadbury v. Bell, it is alleged that Bell, the Hamilton City Prosecutor intentionally gave false information in an order of protection hearing on November 20, 2009. Giving false information within an order of protection hearing is a crime.

In Spreadbury v. Wetzsteon et. al., a false misdemeanor arrest warrant was issued, and executed in the middle of the night. Spreadbury alleges that Wetzsteon was a law student without a license to practice law, and Corn instructed her to prosecute Spreadbury. Corn has been the Ravalli County Attorney since 1991.

The actions by the Defendants caused severe emotional distress, and they are alleged to be intentionally inflicted.

The actions were televised, published in the newspaper, and caused undue emotional distress that has permanently changed Spreadbury’s professional life. Damages sought are: $500,000 from Roddy; $400,000 from Wetzeon/Corn; $275,000 from Bell. Total damages are $1.2M. The arrests of the Defendants are pending in Missoula District Court by way of MCA 27-16-102 (2). No Judge assignments, or dates for court have been set. Delay tactics have been used by Montana State Judges against Spreadbury.

Affidavits are sworn to arrest City, County Prosecutors.


Hamilton, Montana- Affidavits were constructed for the arrest of Hamilton City Prosecutor Kenneth S. Bell, and County Prosecutor George H. Corn of Ravalli County.

Under Montana Law, an arrest can be requested to a court for the willful injury to someone’s character or person as prescribed in MCA 27-16-102 subsection 2. The affidavits request the arrests with respect to pending cases: Spreadbury v. Bell and Spreadbury v. Wetzsteon et. al. . These are civil cases filed in the 21st Judicial District in Ravalli County, with Missoula Judges due to be assigned due to conflicts of interest.

Bell is alleged to have pantomimed, gestured, and otherwise presented false information in an order of protection hearing on November 20, 2009 in Hamilton’s Municipal Court. Bell was not representing a city interest, nor a city employee in the hearing for petitioner Ms. Nansu Roddy. Giving false information in a civil order of protection hearing is a crime. This action by Bell on November 20, 2009 gave Spreadbury significant emotional distress.

Mr. Corn assigned a law student (without Montana Bar License) in the summer of 2007 to prosecute Spreadbury by the name of Angela Wetzsteon, who now works for Corn in the Ravalli County Attorney Office. The unsupervised Wetzsteon secured a false misdemeanor arrest warrant for Spreadbury, with excessive bail, which was later executed at 3am August 11, 2007 by Ravalli County Sheriff Deputies. Only felony warrants can be executed in the middle of the night. Spreadbury was due to return to Missoula International on August 11, 2007 and was not home at the time of the incident.

The affidavits seek arrest of Prosecutors Wetzsteon, Corn, and Bell for willful harm to person or character, namely Michael Spreadbury of Hamilton, MT. District Judges from Missoula, MT will decide the fate of the prosecutors due to a conflict of interest: Roddy is a former spouse of Honorable Jim Haynes, a Hamilton District Judge, and the man who recommended Bell to his City Prosecutor position.

US Magistrate Judge Jerimiah C. Lynch approves civil rights case against Ravalli County Officials .  Twenty (20) defendants, 47 counts, actual damages top $4M.

            Ravalli County, Montana-  Officials in Ravalli County Montana face one of the biggest civil rights lawsuits The State of Montana has ever seen, for allegedly conspiring to deprive the civil rights of Plaintiff Michael Spreadbury of Hamilton, Montana.

Defendants include local and county law enforcement officials, and three (3) prosecutors within the Ravalli County Attorney office.  Private parties such as SAFE of the Bitterroot, and   Missoula, Montana attorney Mathew Stevenson (esq.)are named as Defendants in the federal lawsuit for civil rights.  Look for more activity in the court docket by the fall of 2010.

US MAGISTRATE APPROVES HEALTH & SAFETY LAWSUIT AGAINST US DEPT. OF HEALTH AND HUMAN SERVICES, NATIONAL INSTITUTES OF HEALTH

Hamilton, MT-- A National Environmental Policy Act (NEPA) case was filed against Rocky Mountain Laboratories (RML) and approved by the US District Court for Montana.

In the suit, allegations of deprivations of the NEPA act for projects for the RML campus in Hamilton, MT.  Alternatives to projects, and impacts required by NEPA were alleged to be omitted.  Also, the suit alleges that safety lapses, such as adequate fire protections are lacking at campus that contains a Bio Safety Lab 4 (BSL-4).  The NIH facility in Hamilton is the only NIH BSL-4 Lab in the United States protected by volunteer fireman, whereas the NIH headquarters in Bethesda, MD has 30 federal firefighters onsite, and well respected, equipped Bethesda Fire Department within a few minutes response of NIH's Bethesda Campus.

Rocky Mountain Labs relies upon the Missoula Fire Department (45 mi. from RML) for materials safety and fire response at RML when roadway accidents, fallen trees, and inclimate weather can make asset delivery to a potential RML site emergency impossible.  The suit seeks declarative and injunctive relief, meaning a judges decicion on possible NEPA violations, and force RML to make changes via court intervention, and court supervision until the court is satisfied with the result.

In 2004, a successful NEPA suit was filed by Womens Voices of the Earth, Friends of the Bitterroot, and a third organization for violations of the required elements of NEPA.  NIH settled out of court in an agreement that required arbitration of any return by the 2004 parties against NIH.  The settlement had RML design a public emergeney plan, better filters for the BSL-4 laboratory, a promise not to weaponize or analyze weaponized substances, and to communicate to the public the substances being worked on at RML.  A treatment protocol was also established for local hospitals in Missoula, MT and Hamilton, MT.

The current suit is for the benefit of the public, asks for no monetary relief, and asks the US DHHS, NIH, and RML to follow Federal Law that they are alleged of violating.  The aim is to protect the public from potiential harm, protect resource use at the RML facility, uphold environmental laws, and ask the court to ensure RML's compliance with NEPA provisions in current and all future actions at RML.

CHIEF PUBLIC DEFENDER RANDI HOOD ASKED TO RESIGN


Butte, Montana- Chief Public Defender for the State of Montana, Randi Hood was asked to resign her position this week, acording to sources in the State.

The Montana Public Defenders office has been criticized for poor management, and conflict of interest problems that affect the service they can give to the people of Montana.

Things are so bad within the Office of Public Defener in Montana that the Montana ACLU is gearing up to fix the problems via a lawsuit.  Governor Schweitzer's office was contacted as to the resignation letter sent to Hood this week.  A Washington DC think tank found the conflicts of interest within the Montana OPD.  What they did not find is the conflict that Randi Hood has in her own household: her spouse is a recently retired assistant Attorney General in Montana.

Written complaints went unanswered for over a year at the Montana Office of Public Defender in Butte, Montana.  Calls and other correspondence to the OPD went unanswered, and Hood was never available to the public.  The resignation request also arose from a written threat to remove services from a regional Manager for the OPD in Hamilton, David Stenerson.  The OPD did not employ social workers to determine eligibility, although criteria for acceptance is 133% of poverty status as set by Montana Code.

Due to many problems within, and the services Montana OPD can provide, it is urged that Randi Hood, Chief Public Defender will step down and allow the needed fixes to take shape.  Montana ranks 48th in the nation for justice, so the problems at Montana OPD come at no surprise.
